Distance Contract

This Distance Contract (hereinafter – the Contract) is concluded between the owner of the online store www.pastkrekls.lv, SIA “Julija Zandersone Impact”, reg. No. 42103045882, legal address: Ezera iela 5, Mežezeri, Salaspils novads, LV-2121, Latvia (hereinafter – the Seller), and a buyer at least 18 years old who places an order and makes a purchase on the www.pastkrekls.lv online store (hereinafter – the Buyer). The Distance Contract applies to all orders and purchases made on the www.pastkrekls.lv online store (hereinafter – Pastkrekls site). This Distance Contract does not apply to purchases made by the Buyer in the Seller’s retail stores.

General Terms

1. The Buyer orders, purchases, and pays for, and the Seller delivers and sells goods (hereinafter – Goods) in accordance with the terms of this Contract.
2. The Buyer purchases Goods by filling out the relevant order form on the Pastkrekls site. When placing an order, the Buyer undertakes to provide accurate information, i.e., name, surname, delivery address, and contact information. The Buyer undertakes to inform the Seller of any changes no later than 24 hours after receiving the order confirmation by writing an email to info@pastkrekls.lv. The Buyer is responsible for providing correct data; otherwise, delivery of the Goods may be delayed or impossible. Ordering Goods is considered the Buyer’s offer to the Seller to conclude this Contract for the delivery of the ordered Goods and the Buyer’s consent to purchase the ordered Goods at the indicated price.
3. By placing an order, the Buyer confirms that they have read, understood, and agree to the terms of the Contract and undertakes to comply with and fulfill them. The Buyer is not allowed to place orders if they have not read and agreed to the terms of the Contract. The Contract is prepared in accordance with the laws and regulations of the Republic of Latvia.
4. The Contract applies to various types of Buyers, both unregistered clients and Buyers who receive additional benefits and discounts.

Purchase Price and Delivery

5. Product prices on the Pastkrekls site are indicated in EUR. All prices include any applicable value-added or other taxes. Goods are sold at the prices valid at the time of placing the order. The total delivery price may include surcharges. Depending on the Buyer’s bank or payment method, bank commissions may apply.
6. The Buyer pays for the Goods in the online store www.pastkrekls.lv by debit or credit card (MasterCard, Visa, Maestro, Visa Electron). All delivery costs to Latvijas Pasts parcel machines within Latvia are covered by the Seller. International delivery costs are covered by the Buyer.
7. International delivery of Goods is carried out by the Seller to the address specified by the Buyer for a fixed fee. The Buyer pays the shipping and Goods costs together, before receiving confirmation and delivery from the Seller. The delivery price is included in the invoice. The electronic supporting document – invoice is valid without a signature.
8. Upon delivery of the Goods, the Buyer undertakes to sign a receipt for receiving the Goods.
9. Orders can be placed by the Buyer 24 hours a day, but order processing by the Seller is carried out: on business days from 9:00 to 17:00, on Saturdays and Sundays – no processing is done. The Seller sends the Buyer confirmation of order acceptance by email. If the Buyer does not receive a confirmation email, the order has not been accepted. Order processing begins when the money is credited to the Seller’s account.

Quality Guarantee and Liability

10. Pastkrekls assumes no responsibility and does not guarantee that the goods will always meet the Buyer’s wishes beyond what is stated in the product description. If the Buyer is not satisfied with the quality of the goods, upon receiving the order, the Buyer may return the specific product and receive a full refund for that product.
11. The goods displayed on the Pastkrekls site may differ slightly in size, shape, and color from the received goods due to the technical characteristics of the devices used for ordering or other reasonably foreseeable differences.
12. The description and instructions for use of all goods sold on the Pastkrekls site are indicated in the product description attached to each product.

13. The Buyer can contact Pastkrekls:

Final Provisions and Dispute Resolution

14. If the Seller breaches the Contract, the Seller is liable only for the Buyer’s direct losses resulting directly from the breach.
15. The Seller has the right to change the Contract in full or partially discontinue the operation of the Pastkrekls site. The Seller will notify about changes or discontinuation of the Pastkrekls site by posting notices on the Pastkrekls site and/or in the Seller’s stores, and/or by email to each Buyer and will request the Buyer’s confirmation of the current version of the Contract before any new purchase/order.
16. The Contract is valid until all obligations between the Seller and the Buyer are fulfilled.
17. The Contract is prepared in accordance with the laws of the country from which services are provided to the Buyer and which regulate them, and all disputes are resolved in court in accordance with the laws of the jurisdiction in which the relevant Seller’s company is established.
18. If a court or other competent authority finds that any provision of the Contract is unlawful, incorrect, or unenforceable, the decision does not affect the validity and full applicability of the remaining provisions of the Contract in accordance with the regulations.
19. The Seller reserves the right to block the Buyer’s ability to make purchases on the Pastkrekls site for a limited or unlimited time if dishonest actions are detected or if facts about previous dishonest actions by the specific person on the Pastkrekls site are established. Dishonest actions may be defined as fraud-related activities or other activities that may disrupt the Seller or the operation of the Pastkrekls site and/or cause direct or indirect losses.
20. Disputes between the Buyer and the Seller are resolved through mutual negotiations. If the Seller and the Buyer cannot resolve the dispute through negotiations, the Buyer may submit a complaint to the Consumer Out-of-Court Dispute Resolution Commission, located at Brīvības iela 55, Riga, Latvia, LV-1010, which resolves consumer disputes (more information about dispute resolution is available at www.ptac.gov.lv) or go to court. In addition to the above, the Buyer may use the Online Dispute Resolution (ODR) platform to resolve disputes regarding goods or services purchased on the website. Processing of Personal Data

The Buyer’s personal data will be used to identify the Buyer and receive orders, process and deliver orders, prepare accounting documents, including invoices, refund overpaid amounts and amounts for returned goods, to administer financial and other obligations arising from this Contract and other cooperation documents related to the parties’ cooperation, as well as for the use of services offered on the Pastkrekls site.
